STOP Terror Trials in Pittsburgh; Tim Murphy Vows NO Terror Trials


That is it!!! This is the last freaking straw!!! These libtards are really pissing me off!!! BIG TIME, PISSING ME OFF!!!! I just received an email from my Representative, Tim Murphy (R-PA), that Obama and Holder are looking to move the terror trials for Khalid Sheikh Mohammed and his four accomplices from NYC to another location trial , and that they are considering Western PA, and specifically right here in Pittsburgh as a place to hold the terror trials. HELL NO!!!! Tim Murphy is doing everything within his power to hault this travesty from happening. I don't want these freaking terrorists right in my backyard.


The safest place to try these terrorists and achieve justice without breaking the government's piggy bank and increasing the deficit, and keeping everyone in the United States safe is at Guantanamo Bay in Cuba. Having the trials at Gitmo would take care of all the issues revolving around these trials for enemy combatants or terrorists. Murphy vows NO PITTSBURGH TERROR TRIALS. Everyone in the Pittsburgh area and in PA must stand up and say no terror trials HERE. This cockamamie B.S. Must stop!!! The Obama administration seems to be doing everything in their power to undermine our national security. And, by having the trials anywhere within the United States proper they are endangering U.S. citizens' lives and exposing the United States to an increased possibility of another major terrorist attack.

For anyone to think that these extremely dangerous terrorists who plotted to kill 3000 innocent Americans, who were captured on a foreign battlefield, should receive the same rights as civilians living within the United States is absurd, despicable, irresponsible, and plain callous with respect to American lives and our safety. These people lack the necessary intelligence and conceptual ability to understand about how our military system works as opposed to the laws of common criminals within the United States. These terrorists do not have miranda rights. People who are applying American rights to terrorists captured on a foreign battlefield are displaying cultural imperialism of the worst kind.This lunacy must stop!!! We must stop these terror trials from being located in Pittsburgh or any other city within the United States. These terrorists must be tried in front of a military tribunal.

As the Obama Administration seeks to move the trials of self-professed 9/11 plot mastermind Khalid Sheikh Mohammed and his four accomplices out of New York City to the Western District of Pennsylvania, Congressman Tim Murphy (PA-18) released the following statement:


“The forum shopping by the Justice Department for the Khalid Sheikh Mohammed trial clearly reveals the underlying problems in trying international terrorists and enemy war combatants as domestic criminals in the U.S. criminal justice system.


“We aren't talking about shoplifters or tax evaders, these terrorists are murderers of thousands of innocent Americans and have committed unspeakable acts of war against our country.


“No amount of federal funding can compensate for the risk that this trial would place on the people of Pennsylvania or any other state in our Union. It is outrageous, insensitive and misguided for the President and the Attorney General to unnecessarily jeopardize the safety of U.S. citizens by moving these trials to anywhere outside of the military base at Guantanamo.


“We are seeing universal rejection across party lines and state lines because the American people do not want the government treating terrorism as a U.S. law enforcement issue. Bringing terrorists into Pittsburgh for trial would put a target on our local judges, jurors and all the citizens of our region for a terrorist attack and is a move that that I will fight on all fronts to stop.”

Politicians began lining up Friday against a potential trial of 9/11 terror suspects in Western Pennsylvania, where one of the hijacked airliners crashed.



"Although we are not dead set against it, we would have to hear two things," Gov. Ed Rendell said after New York's top police official said he thinks the trial won't take place there. "First, why it would be safer for Western Pennsylvania than for New York City; and second, what portion of the cost for security and other things would the federal government absorb?"


The Obama administration is drafting plans to move out of Manhattan the trials of professed 9/11 mastermind Khalid Sheikh Mohammed and four alleged accomplices, two administration officials said.


"As Pennsylvania directly experienced part of the attack on September 11th, we are acutely interested in seeing the perpetrators brought to justice," said Allegheny County Executive Dan Onorato. "However, the last thing Pennsylvania needs is a terrorist trial that raises security concerns and places even more of a burden on our taxpayers."


The Sixth Amendment dictates that civilian trials for the suspects must be held in one of the areas where planes crashed Sept. 11, 2001, according to Bruce Antkowiak, a law professor at Duquesne University. That leaves the Southern District of New York, the Eastern District of Virginia -- the location of the Pentagon -- or the Western District of Pennsylvania, which includes Somerset County, where United Flight 93 crashed.


"The presumption is the trial should take place in the district that the crime was committed," Antkowiak said.


Officials in this district's three federal courthouses in Downtown, Erie and Johnstown said they had no word of a move to Pennsylvania. Chief U.S. District Judge Gary Lancaster said he couldn't comment on any matter that might come before the court. Federal agencies in Pittsburgh referred questions to the Justice Department.


Justice spokesman Dean Boyd said he couldn't confirm whether the trial would move, or where it would go.


"We are considering our options," he said.


Mary Beth Buchanan, the former U.S. attorney for Western Pennsylvania, said holding the trial in this district would be expensive and drain resources.


"It's impossible to predict how long this trial might take," she said, noting the complicated charges. It would tie up U.S. marshals who protect courtrooms, she said.


"It would be outrageous to put the financial burden of these trials on the citizens of Western Pennsylvania," Buchanan said.


Sens. Bob Casey Jr. and Arlen Specter said they had no information the trial would move to Pennsylvania, but they oppose the idea and told the Obama administration.


"Mayor Bloomberg has given good reasons why the trial should not be held in New York City, and that same reasoning would apply for Pennsylvania as well," said Specter, D-Philadelphia.


Specter's opponent in the May primary, U.S. Rep. Joe Sestak, said he supports civil trials in U.S. courts for terror suspects, no matter the location. Republican Senate candidate Pat Toomey opposes holding the trial anywhere but before a military tribunal.


"Holding Khalid Sheikh Mohammed's trial in New York City was a terrible idea from the beginning, due to the many security concerns, but moving the trial elsewhere does not solve the problem," Toomey said.


The plan to hold the trial in New York started to unravel when police Commissioner Raymond Kelly detailed costs and logistical challenges of ensuring security at the Federal Courthouse in lower Manhattan, he said.


Criticism of the plan that Attorney General Eric Holder announced last year reached a crescendo this week when Mayor Michael Bloomberg reversed his earlier support.


New York Gov. David Paterson said he was "elated that our concerns are being considered by the president and the federal government."


Pittsburgh Mayor Luke Ravenstahl would have similar concerns, his spokeswoman said.


"The same ones outlined by Mayor Mike Bloomberg -- that the trial could put our citizens in danger, as well as the exorbitant costs associated with the trial, something that we could not withstand," spokeswoman Joanna Doven said.


Hosting such a high-profile trial poses a slew of security challenges, from international terrorist organizations seeking to disrupt it to domestic hate groups, said Danny Defenbaugh, a security consultant and 33-year veteran of the FBI. The threats remain the same no matter where the trial takes place, he said.


"An example that is much less magnified is when we moved the Oklahoma City bombing trial from Oklahoma City to Denver," Defenbaugh said. "We still had the same types of hate groups (to guard against). It didn't matter to them whether we were in Oklahoma City or St. Louis, Mo."


Moving the trial would be a setback for President Obama. His administration spent weeks defending its handling of terror threats after the attempted Christmas Day bombing of a Detroit-bound airliner, which reignited the debate about whether terror suspects should face civilian or military justice.


Obama long has supported trying some terrorists in federal, civilian court, while Republicans argue terrorists should be tried in military tribunals where other Guantanamo Bay detainees will be judged.


White House spokesman Bill Burton said Obama believes Mohammed and his alleged accomplices could be successfully and securely brought to justice in a federal court.

Planning February 6th Protests Against KSM's Civilian Trial in NYC


The KSM civilian trial is going to be a "show trial" that enables KSM, the mastermind of 9/11 and the four other terrorists responsible for planning 9/11 to rile up and encourage and round up the other terrorists all over the globe. This will also give them a platform to spew their hatred for America, The Bush administration, and our brave men and women in the military. This will make America and especially New York City a huge target for another terrorist attack. Eric Holder and his comrades are giving KSM his wish to be tried in NYC and to be given a lawyer. So, for some reason our Attorney General is accommodating a terrorist and appeasing him by granting his very wishes. Some people think that us doing nothing to stop terrorism will bring peace. These people are very misguided because terrorists do not stop their actions just because we are lax in our security and stop fighting terrorism across the globe. Terrorists look for our weaknesses so that they can attack the West at every chance they can get. Terrorists want to destroy the West and not live peacefully with us. These terrorists do not want to coexist with us, they want to conquer the whole world in honor of Allah and kill us. The attack on 9/11 was an Act of War and nothing less. KSM and the other terrorists must be treated as our enemy, and not as mere civilians who just committed a crime. Eric Holder and Obama's decision to try our enemy in a civilian court room is unconscionable. Obama and Holder are giving the terrorists more rights than are required by International Law. Why in the heck would our government give more rights to terrorists during wartime? It just doesn't make sense.

Since hearing the news from Eric Holder God has inspired me and I have felt called to do something in response to this agriegous act being perpetraited by our own government. I came up with the idea to have a day of protests in both New York City and in the Pittsburgh/Shanksville area. The protests will take place on February 6, 2010. Michael Johns, the National Tea Party Leader and a friend from twitter, and Greg a friend from the group PCRG which I joined earlier this year is helping out with the planning this event. I would love it if you would attend one of the protests. The plan is for the protest in New York City to start at 11:00am and the one in Pittsburgh will start at 3:00pm. Michael Johns has most generously agreed to speak at both protests. Pamela Geller from Atlas Shrugs has been most gracious and agreed to be a speaker in NYC. I have emailed Glenn Beck and will email Sean Hannity today. I have started a facebook group also. I hate asking for donations but being a college student of financially limited means, we are looking for donations in order to pay for the protest fees and sound systems. Any amount would be greatly appreciated. And, if you have any ideas on how to promote this great cause I appreciate any and all ideas.

There is no good reason for the decision to try Khalid Sheikh Mohammed in a New York City civil court room. Everything was in place to have these terrorists tried in front of a military commission. At no time in history have our military been required to give our enemy miranda rights which are required for a defendent who has a civilian trial in America. So, are all their admissions of guilt going to be thrown our because of not being mirandized? Is this what Eric Holder and Obama want? I don't know. If they truly loved this country and cared about the American people's safety Holder and Obama would have let the military commission proceed with their trials against these terrorists- our ENEMY. Eric Holder and President Obama are extending rights to KSM and the other terrorists as if they were civilians living in the U.S., or U.S. citizens, when they were actually captured on a foreign battlefield. I will say this again: This is unconscionable!!

Here is both the definition of an unlawful enemy combatant and the explanation of the jurisdiction of military commission as outlined by the Military Commissions Act of 2006. With these provisions in place to try terrorists in front of military commissions there is absolutely no good reason why KSM and the four other terrorists are being tried in a New York City civilan court room.

‘‘In this chapter:


‘‘(1) UNLAWFUL ENEMY COMBATANT.—(A) The term ‘unlawful

enemy combatant’ means—

‘‘(i) a person who has engaged in hostilities or who

has purposefully and materially supported hostilities

against the United States or its co-belligerents who is

not a lawful enemy combatant (including a person who

is part of the Taliban, al Qaeda, or associated forces);


or

‘‘(ii) a person who, before, on, or after the date of

the enactment of the Military Commissions Act of 2006,

has been determined to be an unlawful enemy combatant

by a Combatant Status Review Tribunal or another competent

tribunal established under the authority of the

President or the Secretary of Defense.


‘‘(B) CO-BELLIGERENT.—In this paragraph, the term ‘cobelligerent’,

with respect to the United States, means any State

or armed force joining and directly engaged with the United

States in hostilities or directly supporting hostilities against

a common enemy.

 
‘‘§ 948d. Jurisdiction of military commissions

‘‘(a) JURISDICTION.—A military commission under this chapter

shall have jurisdiction to try any offense made punishable by this

chapter or the law of war when committed by an alien unlawful

enemy combatant before, on, or after September 11, 2001.


‘‘(b) LAWFUL ENEMY COMBATANTS.—Military commissions under

this chapter shall not have jurisdiction over lawful enemy combatants.

Lawful enemy combatants who violate the law of war are

subject to chapter 47 of this title. Courts-martial established under

that chapter shall have jurisdiction to try a lawful enemy combatant

for any offense made punishable under this chapter.


‘‘(c) DETERMINATION OF UNLAWFUL ENEMY COMBATANT STATUS


DISPOSITIVE.—A finding, whether before, on, or after the date of

the enactment of the Military Commissions Act of 2006, by a

Combatant Status Review Tribunal or another competent tribunal

established under the authority of the President or the Secretary

of Defense that a person is an unlawful enemy combatant is dispositive

for purposes of jurisdiction for trial by military commission


under this chapter.


‘‘(d) PUNISHMENTS.—A military commission under this chapter

may, under such limitations as the Secretary of Defense may prescribe,

adjudge any punishment not forbidden by this chapter,

including the penalty of death when authorized under this chapter

or the law of war.

Eric Holder and His Leftist Comrades Are Responsible For Delaying Trials

In Andrew McCarthy's article, he explains how Eric Holder himself along with his friends are the reason that there were so few military trials. Many of the same lawyers that obstructed the Bush administration efforts in bringing terrorists to military trial are now working for the Obama Justice Department. Yeah. You heard that right. The very lawyers that at every chance they got blockaded the Bush administration's efforts to bring these terrorists to justice are the same ones today advising BO to try Khalid Sheikh Mohammed in a NYC courtroom because of delays which they themselves caused.


So, these leftist lawyers aided the terrorists at every chance they could get just to fill their leftist disdain for the Bush administration who vowed to bring justice to our enemies' and they campaigned against justice being served upon terrorists who were co-conspirators in committing the heinous acts of terrorism against our country, including the tragedy of 9/11. If it wasn't for these leftist lawyers, then justice would have been swiftly served upon these Islamic Jihadists. This type of justice would have honored all of the 9/11 victims. But, this court masqerade in NYC will only disgrace those lives lost on 9/11. The families of 9/11 victims have had to endure the delay of justice for their loved ones, not due to the Bush administration, but rather because of Holder and his gang of leftist lawyer cronies who craved for this NYC courtroom moment to show off just how much disdain they have for an America which would fight against terrorists in an all out frontal assault instead of merely waiting for another attack to happen on American soil while playing like nice little boys and girls with the terrorists. War does not work like that. In war you must give it your all to protect the country and citizens you serve instead of doing a half-ass job like our current president is doing now.

Holder's law firm Covington & Burling donated over 3000 hours of free legal assistance to our enemy detainees. Holder and the rest of our enemies' lawyers strongarmed the court's liberal bloc to invalidate military commissions charging that the commissions were not prescribed by Congress, but that they were actually prescribed by the President. This was unfounded and false. The left only knows how to distort reality for personal gain. Congress had in all actuality approved military tribunals in the 2005 Detainee Treatment Act. Should Eric Holder and his leftist comrades be charged with aiding our enemy? It sure seems that way to me since they blocked every effort to bring justice to terrorists. And now, their form of justice might include the aquittal of terrorists -- terrorists who committed heinous acts -- only to fulfill their malicious desire to make a mockery of the Bush administration when they were merely doing their job to protect American citizens from enduring the wrath of another 9/11 type of attack.


It is obvious that Holder and his gang of lawyers must have had an agenda straight from the beginning. If these leftist lawyers really had even a miniscule amount of love for America, and wanted to protect Americans, they would have allowed the military commissions to proceed under the Bush administration. Before 2006, Congress implicitly approved military commissions. In 2006 Congress explicitly approved the Military Commissions Act. After this Act was passed both the Al-Qaeda bar and the terrorists volunteer lawyers went to work simultaneously attacking the new commission system. Unfortuantely, it wasn't until well into 2008 that a lower court ruled that leftists abominable Bourmediene court decision did not invalidate the military commissions. Holder and his leftist comrades should not have been permitted to work in any aspect of the government and much less the Justice Dept. These anti-American leftists lawyers should have been brought up on charges for impeding justice and thus aiding the enemy. This administration is both a disgrace to America and its citizens. This administration sickens me. . .
