Are Law and Morality Inextricably Linked?

I recently had a back-and-forth conversation with a fellow conservative blogger who claimed that you cannot legislate morality.  This is untrue.  Laws legislate morality all the time.  If the law didn't legislate morality then we as a society would permit such crimes as murder, theft, sexual harassment, rape, sexual assault, prostitution, and speeding and as a result there would be complete chaos.  The law and morality are inextricably linked.  It is impossible to remove morality from the law.  Laws help to form our moral compass. In addition, these laws help to change hearts, minds, and souls.  Since Michael Bauman is able to explain that the law and morality go hand-in-hand, that all laws legislate morality better than I am able to, I will leave you with his arguments on this subject which he presents in his article, Law and Morality.



SUMMARY
Because every law springs from a system of values and beliefs, every law is an instance of legislating Morality. Further, because a nation’s laws always exercise a pedagogical or teaching influence, law inescapably exerts a shaping effect over the beliefs, character, and actions of the nation’s citizens, whether for good or ill. Those who seek to separate morality from law, therefore, are in pursuit both of the impossible and the destructive. The question before us is never whether or not to legislate morality, but which moral system ought to be made legally binding.

The constant or determined repetition of an error does not make it true. Errors are errors regardless of their prevalence or the persistence of those who advance them. Indeed, given the egregious foolishness of some of our most widespread beliefs in the recent past, the great popularity or predominance of a notion sometimes is enough to raise suspicions about its truthfulness. We moderns too eagerly and too often live our lives on the basis of insupportable, indefensible, half-true “truisms” that cannot stand up to close analysis. The assertion that you cannot legislate morality is just such a notion. No matter how often one hears that you cannot legislate morality, the truth is that you can legislate nothing else.

All laws, whether prescriptive or prohibitive, legislate morality. All laws, regardless of their content or their intent, arise from a system of values, from a belief that some things are right and others wrong, that some things are good and others bad, that some things are better and others worse. In the formulation and enforcement of law, the question is never whether or not morality will be legislated, but which one. That question is fundamentally important because not all systems of morality are equal. Some are wise, others foolish. Few are still in their first incarnation, nearly all having been enshrined as law at some time or place, often with predictable results. For better or worse, every piece of legislation touches directly or indirectly on moral issues, or is based on moral judgments and evaluations concerning what it is we want or believe ought to be, what it is we want or believe we ought to produce and preserve.

LAW, MORALITY, AND THE FOUNDING OF AMERICA
When the Founding Fathers drafted our original Constitution, they did so on the basis of competing belief systems, competing assertions of right and wrong, which they endeavored to build into the Constitution. One or more of those belief systems permitted slavery, others did not. No side in the slavery debate at the Constitutional convention argued that you could not legislate morality. They all recognized that notion as balderdash. They knew that indeed you could legislate morality, and they intended for that legislated morality to be theirs.

Nor did any side in the struggle to legislate morality at our nation’s founding say to its opponents that trying to legislate morality was a breach of the wall of separation between church and state. Morality, after all, is not a church. They would have laughed at the confusion of mind revealed in one who thought that separating church from state meant separating morality from law. They wanted the nation to be moral. They wanted its laws to be just. But they did not want to give any one church a national legal advantage over the others. They did not want the nation to be Presbyterian, Baptist, or Roman Catholic, which is a far different issue from whether or not to have ethics-driven law.1 Under the Constitution the Founders enshrined freedom of religion, not freedom from religion. In seeking to avoid a state-established church, they were not thereby establishing secularism or separating law from morality.

The very fact that the Founders were creating a new Constitution for their fledgling nation arose because they understood the actions of King George to be morally evil, and politically unjust.2 They all knew quite well that morality belonged in politics, in fact that politics was simply morality applied to the public square, to the public’s business.

The Founders sought to establish what they called an “ordered liberty.” The order they sought was provided in part by the morality they intended to enshrine in law. By seeking ordered liberty, the Founders were not seeking anything new or unprecedented in political thought or in political history. They well knew from reading the ancient words of  Aristotle, for example, that morality encoded in civil law helped to provide order, since law inescapably has a teaching function, or pedagogical effect. Law teaches the citizens what is right and good, and it punishes those who cannot or will not learn that lesson.  CONTINUED

Voyagers!: I Wish We Had TV Shows Like This Today

As of late, I have been thinking about old television shows. Do you remember when most T.V. shows that were on television were wholesome, promoted ethical values, didn't have an anti-American slant, and didn't promote a political agenda? My husband and I began to make a list of old TV shows which we enjoyed watching while growing up. Do you remember any of these: Voyagers!, The Electric Company, Picture Pages, Captain Kangaroo, Chips, Emergency!, Little House on the Prairie, The Waltons, Walker Texas Ranger, The Brady Bunch, The Incredible Hulk, Lassie, Fat Albert, Great Space Coaster, Barney Miller, Good Times, and What's Happening!! ? Wouldn't it be nice if we had T.V. shows like this today that didn't propagandize kids?  Some of these were reruns when I was growing up.  Having shows that teach good morals is especially important for children today. What were some of your favorite T.V. shows growing up?

Did The Government make "Most Blacks" Immoral?



This is an excellent interview.  Cenk Uygur, the Young Turk, interviews Reverend Jesse Lee Peterson, and Reverend Peterson blows TYT's mind, making bold statements that no white person could get away with.    According to Reverend Peterson, "most blacks" are morally deficient.  He blames the government, specifically welfare and Lyndon B. Johnson's Great Society programs for replacing the father and making him unnecessary. Even those who are not on those programs are morally damaged because they support them.

Do you agree with Rev. Peterson's assessment?




A theological word of caution: In one part of the interview the host makes reference to Leviticus 11:9-12, and implies that homosexuality is on the same moral plane as eating shellfish (kosher law).  He is dead wrong, but this requires an explanation.
Leviticus is the book in the Pentateuch that pertains to priestly laws about what is holy and unholy.  This is a cermonial law that goes beyond the moral law, just like how in Pre-Vatican II times in the Catholic Faith it was a mortal sin to eat meat on Fridays, or this ceremonial law is analgous to Jews not eating pork.  Eating shrimp is not intrinsically wrong, but homosexuality is intrinsically disordered.  God was preparing Israel for the Incarnation of Jesus.  That was the whole purpose of of the Old Covenant ceremonial laws.  With Christ's sacrifice an institution of the New Covenant the old temperal cermomial laws have been replaced but the moral law is eternal.  It remains unchanged.  The prohibitions against murder, theft, blasphemy, impiety, covetousness, and sexual immorality (adultery, incest, bestiality, and, yes, homosexual acts) are everlasting.

OVARIES: Lock 'Em Away!

From Pittsburgh-Tribune, a Pittsburgh woman is accused of leaving her baby in the car: PITTSBURGH (AP) -- A Pittsburgh woman is accused of leaving her baby girl locked in a car in subfreezing temperatures.

Twenty-five-year-old Dori Lee Zielmanski was arrested after she returned to the car Monday evening.
Police say she told them she left the baby in the car while she went to the bathroom. Investigators say a passer-by noticed the child and called police.
Authorities say the baby was left alone for at least 15 minutes in the car in the Bloomfield neighborhood.
Zielmanski faces charges including child endangerment. She was arraigned early Tuesday morning. It was not immediately clear if she was still in custody.
The baby was transported to a hospital to be checked out. Social workers are now caring for the girl.

Alright, stupidity is the word of the day. How can women, mothers specifically, but also people in general lack, be so lacking in common sense and turn into irresponsible nitwits? Did common sense go out the window? AAAHHHH!!! (scream) Some people are too stupid or not raised properly by their parents to know how to take care of babies and kids of their own. These people who are stupid should not engage in "safe" sex. It makes me think of the image below. It comes to us from Sig94 at Goomba News Network. He came up with this funny slogan in response to N.O.W. and other pro-abortion groups who are against the Tim Tebow ad airing during the Super Bowl. I think it is most appropos for this situation also. First of all, who in the heck in their right mind would leave a baby or child in their car? In an unsafe neighborhood? Bloomfield is an okay neighborhood, but in my opinion it is not an extra specially safe neighborhood. But, regardless, anyone with any amount of parenting skills whatsoever would NEVER, and I'll repeat this, would NEVER leave their child in a car, let alone in a freezing car. In today's society is there some stupidity contest going on? It sure seems like it. In a poster below you will see that Should women in our society who display a blatant lack of respect for human life, or de-valuing of human life, and nonsensical women who lack the necessary skills to properly take care of their children be sent off to the school of morality & common sense? Sending them off to a school that teaches morals, values, and the difference between right and wrong would really help our society.

My Rant on Health Care & Morality

This health care bill passing cloture last night is an utter disgrace to the American people. These Democratic politicians are giving every American citizen the middle finger by not giving a flying F***K what the majority of American people would want with regards to health care reform. This health care bill, if it passes the senate, will be the destruction of Amercans freedom as we know it today. This bill is tyranny being forced upon American citizens. This bill will raise costs, force health care to be rationed, eliminate competition, and force insurance companies out of business. This bill will utterly destroy our health care system. This bill will destroy our economy. This bill has nothing to do with health care at all. This bill has everything to do with stripping the American people of freedom and liberty. This bill is all about the Democrats gaining power and control over the American people.

All of these communists are following their Dear Leader of tyranny. These communist pigs must be booted from office in 2010. They obviously don't give a rat's ass about the American people. They are a bunch of selfish bastages.

Anyone that supports this bill needs to sent to either Venezuela, or Cuba to fully experience the "benefits" of communism with equal dismal health care to experience being equally financially poor. These people think that profits are evil. If they believe that profits are evil then they should give all of their profits up. Everyone that earns money is in a real sense earning a profit. If anyone wants a raise then they want to reap the benefits of making a profit. If you really do see profits as evil, than forfeit all your rights to profit. The people that think profits are evil will not apply that same principle to themselves. So, these people are a bunch of damn hypocrites.



Because of this liberal and/or communist infiltration into our society, we as a society have fallen away from God given principles and values. We need to return to these Godly principles and values so that our country will be saved from this attack on morality. These communists have infiltrated into our public schools and into our government and have made it crystal cle that they want no mention of God, period. Sure, anyone is allowed to say Allah and are not offended even though violent Jihadist extremists have killed over 3000 innocent Americans. People at the highest levels want to cover up for the Ft. Hood tragedy which was an act of terrorism. They distort Christanity and portray it as an evil when it is those very people that are evil. They just don't want to face reality and the truth. They spread hateful lies about Christianity. These secularists in our society must be stopped. Our Christiann principles must be spread far and wide. Let people hear the word of God all over this country. We must not be intimidated by the people who want to restrict our right to freedom of religion. These secularists want to distort our constitution and portray the words as freedom from religion instead of the actual words in the constitution, freedom of religion. This is false. We must spread the values that our in constitution far and wide. Let them see our Godly actions. This is the time to take a stand for morality and against the secularists in our society today. Let us promote individualism, freedom, liberty, and Godly values all across this land. God Bless America!!

Obama The Anything but Christian President

I just recently saw a video of Congressman Randy Forbes discussing how this nation was built on Judeo -Christian principles and is still a Judeo-Christian nation today. He takes issue with certain anti-Christian Obama rhetoric. Seeing the video of Congressman Randy Forbes brought back my repugnance for Obama's anti-Christian words. Obama on April 6, 2009 said "U.S. is not more a Christian nation, or a Jewish nation, or a Muslim nation." He has also said "We are no longer a Christian nation." With this statement Obama is trying to minimize the importance and the fact that the United States was founded on Judeo-Christian principles. He is trying to further his anti-Christian agenda by disregarding the importance of this nation being founded on Godly principles.



Excuse me but the President is distorting reality. Obama may want to decree from the top down that we are no longer a Christian nation but the reality is that the United States has many Americans today that still practice a Judeo-Christian way of life. The Judeo-Christian principles are very much alive today. Has Obama chosen to make his version of the U.S. not a Christian nation? Obama's native birthplace may be mainly a Muslim nation but the United States of America was founded on Judeo-Christian values and is still mainly a Judeo-Christian nation today. Obama, the anti-Christian President, may want to change or distort that reality but he is going to have a fight on his hands before he corrupts and destroys the morality of this great nation we call the United States of America. I will fight like hell to keep the belief in Christianity alive so that we are not taken down a path filled with moral relativism. Obama, as the Anti-Christian President is distorting reality today in order to promote his secularist or Anti-Christian agenda. He does not exemplify the experience, morality or ethics required to be President of the United States. One example is how he responded stupidly to the question regarding the Cambridge Police and Professor Gates. He is not qualified to be President of the U.S. but unfortunately we had a bunch of stupid oprahbots following their orders to vote for their first African-American President. Obama is trying to change this nation into a secularist society. He has no regard for respecting our Godly Judeo-Christian principles of both past and present. All these liberals like to do is distort reality in order to promote their corrupt agenda. On the campaign trail Obama called for transparency but has not adhered to that promise since being President. In fact, he has been about as transparent as a brick wall. Since Obama has been elected he has consistently been responsible for the demoralization of the United States and promoted an anti-Christian agenda for the United States during speeches both in the United States and overseas.



Evidence that we are still a Judeo-Christian today:

According to the American Religious Identification Survey (ARIS) 76% of Americans identify themselves associate themselves with Christianity.

Chaplains daily prayer in the Senate started in 1789 and Congress still today has a chaplain start the day with a prayer in Congress.

The Walpin Firing: Where There's Smoke There's B.O.

Last Wednesday Inspector General Gerald Walpin learned that he was being fired. Was his being fired due to his astute abilities in finding corruption and misuse of Americorp funds by Obama's friend Kevin Johnson? I smell a stench in the air. I can see the words cover up written on the graffiti-filled bathroom walls. I believe that the corruption from the streets of Chicago has been transplanted to the streets of Washington D.C.

Here is a little bit of background on the life of Gerald Walpin:

Walpin grew up in the Bronx. His parents went hungry so that he could eat dinner. Walpin, while growing up, was a hard worker and continued with the same tenacity during his adult life. With all of his efforts and hard work he made it into Harvard, even though he was unable to pay for it. He would not give up on his American dream. Walpin's dream was to be a litigator. He went to Yale law, took out massive college loans, eventually got a scholarship and graduated from Yale in 1955.


During Walpin's career he has been a 1st Lieutenant in JAG, a special U.S. prosecutor who took on the conservative Ray Cohn, the infamous counsel to an aid of Senator Joseph McCarthy. He also helped to indict Nixon's two cabinet members and represented Mia Farrow against Woody Allen.


In an article by Byron York of the Washington Examiner he stated:

"The White House's decision to fire AmeriCorps inspector general Gerald Walpin came amid politically-charged tensions inside the Corporation for National and Community Service, the organization that runs AmeriCorps. Top executives at the Corporation, Walpin explained in an hour-long interview Saturday, were unhappy with his investigation into the misuse of AmeriCorps funds by Kevin Johnson, the former NBA star who is now mayor of Sacramento, California and a prominent supporter of President Obama. Walpin's investigation also sparked conflict with the acting U.S. attorney in Sacramento amid fears that the probe -- which could have resulted in Johnson being barred from ever winning another federal grant -- might stand in the way of the city receiving its part of billions of dollars in federal stimulus money. After weeks of standoff, Walpin, whose position as inspector general is supposed to be protected from influence by political appointees and the White House, was fired."


Obama has consistently shown that he can't handle any sort of dissent or criticism at all. His huge ego gets shattered at the thought of someone actually disagreeing with him. Obama is proving that if any type of corruption comes to light, and it involves any of his cronies or monetary contributors, he makes sure that the corruption is covered up. In this case, he has decided to get rid of the ethical party. What happened to Obama standing up against corruption? Walpin was acting responsibly, by investigating and following up on a lead that involved corruption. If that lead happens to include Kevin Johnson, one of Obama's friends, so be it.



On Wednesday night when Walpin was contacted by Norman Eisen, Special Counsel to the President and "He said, 'Mr. Walpin, the president wants me to tell you that he really appreciates your service, but it's time to move on,'" At that moment Walpin had just finished a report on the Sacramento probe. He had just also finished an investigation into extensive misuse of AmeriCorp money by the City University of New York, which is AmeriCorp's biggest program. Because of his findings from the investigations of St Hope and City University of New York, top executives kept him out of corporation business that should normally include the Inspector General.


An article by Byron York stated:
"Walpin says he told Eisen that, given those two investigations, neither of which was well-received by top Corporation management, the timing of his firing seemed "very interesting." According to Walpin, Eisen said it was "pure coincidence." When Walpin asked for some time to consider what to do, Eisen gave him one hour. "Then he called back in 45 minutes and asked for my response," Walpin recalls."



I don't think that it was any coincidence at all. This was planned. Obama wanted to stop Walpin before he found any more problems with the way the money was managed at AmeriCorp. Think about it, Obama wants to expand AmeriCorp and if it was proven that the money was mishandled that could have some effect on whether Obama's much wanted program expansion would happen or not. I am sure that Obama didn't want AmeriCorp to be put in a bad light. The fact that Walpin's firing was so sudden and immediate is a telling sign and I believe is much more than a coincidence. If Gerald Walpin wasn't an excellent investigator than why would he be an Inspector General? He was obviously an excellent investigator of corruption which was not affiliated with any political group. He must have been a great investigator for his own good, to find corruption with one of Obama's chummy old friends. Obama by firing Walpin in such an interesting and a sudden way has made this political when the Inspector General is suppose to be apolitical and do independent investigations and follow those investigations wherever that leads him without regard to any particular political party.

Last year, a dispute began, when Walpin recommended that Johnson and St. HOPE be barred from receiving and using federal grant money. This is known as "suspension and disbarment", which means that under the current arrangement Johnson would be suspended from receiving any federal funds and might be ultimately barred from receiving funds in the future. "The whole purpose of suspension and debarment," Walpin says, "is to say that somebody who was involved in the misuse of government funds in the past should not be trusted with federal funds in the future."

Walpin's finding included that Kevin Johnson and St.HOPE did in fact misuse the government funds under the guidelines that were specified in the grant. Johnson used federally-funded AmeriCorp staff for his own personal use, which included: "driving [Johnson] to personal appointments, washing his car, and running personal errands."

Byron York stated:
"Walpin came to the conclusion that Johnson and St. HOPE should be subject to suspension and debarment. But it was not Walpin's decision to make; there is another official at the Corporation whose job it is to make that call. In September 2008, after reviewing Walpin's evidence, the official decided to order a suspension, with the distinct possibility that it would lead to a permanent debarment."

This shows that he was not the only person who came to the conclusion that Kevin Johnson misused federal grant funds and used federal AmeriCorp employees for his own personal gain, which was not apart of their responsibilities as AmeriCorp staff. Did the other official come to the wrong conclusion also? He obviously thought Walpin did a thorough job investigating the matter and that he had proven that Johnson did indeed misuse federal grant money.

In the meantime, Johnson was elected Mayor of Sacramento. After Congress passed the $787 billion stimulus package the conflict became a far more pressing issue since Johnson and Sacramento were hoping to receive aid from the Stimulus package. But, because of Walpin's investigation and assessment of Kevin Johnson's misuse of prior federal funds their would be an insuperable obstacle for Johnson and Sacramento to getting all the funds.

"On March 21, the Sacramento Bee reported that, "The city of Sacramento likely is barred from getting federal money -- including tens of millions the city is expecting from the new stimulus package -- because Mayor Kevin Johnson is on a list of individuals forbidden from receiving federal funds, according to a leading attorney the city commissioned to look into the issue." The issue was explosive. What if there were all that federal money raining down and Sacramento couldn't get any because its mayor had been found to have misused federal money in the past?"

Obviously because of the massive debt California has been facing the past few months or so, Sacramento desperately needed their part of the Federal Stimulus money. Kevin Johnson is the one that had put Sacramento in jeopardy of not receiving any help from the Stimulus. It is not Walpin's problem that Sacramento elected a mayor that had misused federal funds before. I am sure that Obama felt some pressure from one of his top supporters to take care of this situation so that Sacramento could receive federal Stimulus Funds.

The White House claims that Inspector General Gerald Walpin is "confused, disoriented, and unable to answer questions."

"Believe me, the only thing wrong with Gerald Walpin is that his heart hurts from being thrown under the bus by the system he served for so long."

According to the Associated Press, the FBI has opened up an investigation into allegations that an executive obstructed a federal inquiry by deleting emails written by Johnson. In order to settle the investigation St.HOPE Academy agreed to repay close to $424,000 in federal grants.

"I was fired because I did my job," Walpin told KCRA 3 from his home in New York City. "That's bad for our country. It's bad for taxpayers because it's the responsibility of an IG to make sure that taxpayers' money is not wasted."

In my assessment, Gerald Walpin is not disoriented or confused. I believe it is President Obama who is disoriented and confused. He is the one who is acting in a delusional state, trying to cover up and avoid reality, that his friend Kevin Johnson was involved in corruption. Obama is the one that has penalized an inspector general for doing his job extremely well. Walpin was fighting to reduce government waste and the misuse of federal funds. He was doing this by pinpointing where corruption was located, and acting accordingly to get rid of that corruption. Walpin has been wrongly fired for doing his job with precision. Could there be a lawsuit brewing? Obama has proven that he doesn't mind allowing corruption to exist, as long as it has to do with the Democrats. But, should the big, bad, ugly Republicans be involved in corruption, that must be weeded out. Corruption should not be advocated or accepted by any politician from any political party. It should not be a Democrat or Republican issue, in trying to make the other party look bad, but it should be a moral issue.
