King Obama's Power Trip: ILLEGAL Non-Recess Appointments
From Big Peace: In an editorial both Edwin Meese, the former U.S. Attorney General under President Ronald Reagan, and Todd Gaziano, Director of the Heritage Foundation’s Center for Legal and Judicial Studies, stated that President Obama's unilateral appointment of three individuals to the NLRB and Richard Cordray to head the new Consumer Financial Protection Bureau while the Senate was NOT in recess is a “breathtaking violation of the separation of powers and the duty of comity that the executive owes to Congress.”
The authors asserted:
…never before has a president purported to make a “recess” appointment when the Senate is demonstrably not in recess. That is a constitutional abuse of a high order.
The beauty of this editorial is that Mr. Meese and Mr. Gaziano provide instruction to handle this rogue president who continues to thumb his nose at the Constitution. They continue:
President Obama’s flagrant violation of the Constitution not only will damage relations with Congress for years to come but will ultimately weaken the office of the presidency. There eventually may be litigation over the illegal appointments, but it will be a failure of government if the political branches do not resolve this injustice before a court rules…Congressional leaders of both parties must vigorously (though thoughtfully) defend their prerogatives. Senators could filibuster all presidential nominations, as Sen. Robert C. Byrd did in 1985 over a lesser recess appointment issue, until Obama rescinds these wrongful appointments. The House or Senate could condition all “must-pass” legislation for the remainder of 2012 on an agreement to rescind these appointments. The House also could require the attorney general to produce legal justification and testify at oversight hearings.
The authors conclude:
If Congress does not resist, the injury is not just to its branch but ultimately to the people.
Of course as long as Nancy Pelosi gets to advance her agenda, gets her way, she is totally fine with the President abusing his power - the Democrat President.
The Daily Caller points out that in an outrageous move, even more so than his appointment of Richard Cordray to the Consumer Financial Protection Bureau, the President appointed two union lawyers to the NLRB even though the GOP never obstructed his nominees and weren't even given the chance to vet the normal paperwork or do background checks. These appointments are most certainly unconstitutional since Congress wasn't in recess.
Craig Becker, a radical union leader wrote that “Employers should be stripped of any legally cognizable interest in their employees’ election of representatives.” Unfortunately for Obama's pro-union radical agenda, Becker's term expired at the end of 2011. When Congress refused to go to recess so that they could block equally radical outrageous appointments Obama decided to go under the radar while people were fired up over his controversial appointment of Cordray and appoint two union lawyers to the NLRB.
Here is some information on the two new NLRB appointees from The Daily Caller:
The little we know about Block and Griffin is not encouraging. Block was a longtime staffer for Senator Ted Kennedy, and is almost certainly a lockstep vote for the Becker agenda of upending employer rights.
Griffin has the dubious distinction of being the second board member ever (Becker was first) to join the NLRB directly from a labor union. In Griffin’s case, it’s the International Union of Operating Engineers (IUOE), where he was general counsel.
The IUOE is an especially autocratic union that has been criticized by union activists for imposing strict Internet censorship on union members who have the temerity to run against current union leadership. Griffin justified the gag rule as necessary to protect the “union’s sensitive and/or confidential internal workings.” Griffin even tried to impose fines on his own union workers for challenging the gag rule in court.
In 1998 testimony to a House committee, Griffin argued for more expansive NLRB powers to order fines and other remedies, for allowing the board to enforce its decisions without a court order and for allowing unions to organize at single locations. Most significantly, in that testimony Griffin was asked directly whether unions and employers both engage in illegal conduct. He said: “The vast majority of illegal conduct is committed by employers, and therefore the vast majority of charges are addressed to employer conduct.”
Congress needs to pass a joint resolution of disapproval under the Congressional Review Act to send a message to Obama to stop ignoring the Constitution, bypassing the Constitution, to stop abusing his power and reverse his appointments.
MIni Eagle Freedom Links -Coca-Cola Christmas--12-13-11
I have decided to do a series of Mini Eagle Freedom Links this week since I have been feeling fatigued. Probably partially due to my having a Vitamin B12 deficiency. I'm working on remedying that. I still get a little dizzy but thankfully not near as much as before. Still waiting for results from my colonoscopy and endoscopy. It still hurts when I breathe. Not quite as bad as it was, thankfully. I am heading to the ENT doctor on Thursday to find out whether the tube that was in my throat during my surgery is what has caused my throat problems. I am very thankful that I am in the process of fixing my medical issues and that I am feeling better than before. The month of December seems to be flying by very quickly. Is everyone ready for Christmas? Got all your holiday decorations up and presents wrapped? Still shopping for that special person? I still need to put up my Christmas tree and decorations. Have you been watching any Christmas movies? I hope everyone is enjoying this Christmas season.

Changing Educational Paradigms Must Include Stopping Unions from Having a Stranglehold on Kids' Education
For the most part, our educational system is a debacle with massive amounts of money being misallocated by school districts. Our tax dollars are going down the tubes. During the 2002-03 school year $440 billion was used to fund public education for kids from prekindergarten through secondary school. Unfortunately because of the misappropriation of funds in order to benefit the adults instead of the students the effects of this have produced consequences including: illiteracy, high secondary school drop out rates in democratically-controlled areas of the United States, and in 2009 results of testing showed that ONLY 60 percent of high school students are proficient in basic science skills . These aforementioned examples show that it is imperative that we change the educational paradigm in the United States. One question worth posing is what exactly does the phrase "basic science skills" refer to today? How basic is "basic"? The fact that 40 percent of high school students are unable to pass the basic proficiency science test is highly disconcerting and unconscionable. This is further evidence that our public schools are failing, and the teachers' unions are failing to provide children with a good education.
The teachers union in Detroit will have nothing to do with compromising their benefits for the sake of either the school children or the city of Detroit. The unions greedy nature may force the closure of half of the public schools in Detroit. If the unions, democrats and President Obama actually cared about educating our kids properly they would not have been against the DC Opportunities Scholarship Program (a voucher program), and defunded it. The program was an instant hit, and according to the Dept. of Education it was working. This program in Washington D.C. was helping disadvantaged youths yet those (Democrats and unions) who claim to champion for kids quashed the program which was working. How dare those happy and successful kids siphon away money from unions (sarcasm).
Virginia Walden Ford is an advocate for school choice. As an adolescent her son William started struggling with academics and eventually started getting into trouble with the law. Then a generous next door neighbor's intervention changed the trajectory of her son's life when he offered to help pay for William to attend a local parochial school. In a matter of only months there was a major transformation: William went from being an angry kid to really enjoying the learning process. After 2 years he transferred to a charter school and graduated as Valedictorian. He enlisted in the Marines, served in Iraq, and is now working for a real estate company in the Washington D.C. area. After seeing how much a nurturing school enhanced her son's education in the 1990's Virginia became an outspoken advocate for the D.C. vouchers bill. Unfortunately the program was cancelled in 2009 but after the 2010 mid-term elections Ford is hopeful that with the help of Speaker of the House John Boehner the D.C. voucher program will breathe new life soon.
With all the issues in our educational system it is an absolute necessity that we change the educational paradigm in order to prevent a calamitous outcome for the United States.

Unfortunately the program was cancelled in 2009 but after the 2010 mid-term elections Ford is hopeful that with the help of Speaker of the House John Boehner the D.C. voucher program will breathe new life soon.

"College is supposed to be a time of change, a time to question our assumption about the world and define our basic values. For me, the transformations of the last few years have been especially acute. I came to Amherst from a fairly sheltered, privileged, and politically conservative background. I campaigned for Reagan in 1980, and spent the summer after freshman year working for Senator Roth (of Kemp-Roth tax-cut fame.) In the fall of 1983, I was a proud founding member of the Amherst College Republicans. In November 1984, I represented the Amherst Democrats in a hotly contested pre-election debate against my former roommates, co-founders and leaders of the Republicans. As the debate progressed it became obvious how unreconcilably different our opinions had become. What caused such a shift in only one year?

It was in this manner that I soon met a creature I had never known before—a Democrat, several of them. Some of the “Leftists” that I met early on were terrifyingly persuasive, although I never admitted that. A few became my friends and provided a constant nagging backdrop of doubt, for which I am now grateful.
More importantly, during sophomore year, several professors challenged the basic assumptions about America and the world relations with which I had grown up. Cultural Anthropology inspired a fascination with other peoples, and undermined the accepted value of progress and the cultural superiority of the West. In examining the role of myths in “primitive” cultures, we also studied the myth of equal opportunity in this country, a myth I had never questioned. A course on the Vietnam War painted in gory detail a picture of horrible failures made possible by American hubris and dogmatism. I saw the deprivation and oppression of the poor and the politically disfavored in a way not possible in the U.S. In Kenya, my position was not at stake; I was not directly benefiting if the underprivileged had little hope of advancement. I lived with the struggling African family for a month and came to know the hardships that they face. What surprised me was the attitude of the elite; I became friends with a very wealthy businessman and his family and heard them reiterate the same beliefs held by many Americans; the poor are poor because they are lazy, slovenly, uneducated. “Kenya is a land of opportunity,” they said, “those who work receive their just reward.” I knew this was not true in the case of many black Kenyans; this story merely served to justify the position of many who had done well only by working for the British colonialists. I realize that Kenya and America are very different, but experiences like this warned me that my own favorite beliefs in the miracles of free enterprise and the boundless opportunity to be had in America might be largely untrue.
When I returned last summer, I traveled all over the East Coast and saw in many ways a different America. Upon arriving at Amherst this fall, I felt like a freshman at an unfamiliar school all over again. Many of the questions raised by my experiences of the last year remained unanswered. Huge Job Losses Because of Obama's Cap & Ban
From The Foundry : The front page of USA Today claims: “President Obama’s attempt to use the Gulf of Mexico oil spill to help propel comprehensive energy legislation has failed.” Don’t believe it for a second. On Monday the Obama administration reissued a ban on offshore oil drilling in the gulf after federal courts twice invalidated the first ban, calling it “arbitrary and capricious.” The new ban is, if anything, more restrictive than the first, thus guaranteeing even more job losses for the already devastated Gulf region. Meanwhile, Majority Leader Harry Reid (D-NV) is set to introduce a bill that will cap greenhouse gas emissions from power plants. Taken together, the President’s Cap and Ban approach to energy policy will accomplish exactly what he set out to do from the very first day he was sworn into office: decrease the amount of carbon the U.S. economy emits by drastically increasing the cost of energy.
The mechanism Sen. Reid will use to cap carbon emissions is Sen. Jeff Bingaman’s (D-NM) renewable electricity standard (RES) legislation (the American Clean Energy and Security Act), which caps carbon from power plants by forcing them to produce a growing percentage of the electricity they produce from government-approved renewable energy sources every year. This is essentially cap and trade but without the trade. If these new renewable energy sources were actually cost effective, there would be no need to mandate them. Cost-minimizing firms would adopt the technology on their own to stay competitive. But renewable energy is not cost-effective. It is significantly more expensive than traditional fuels, hence the need for the government mandates which will raise everyone’s energy costs. The ultimate victim of these higher energy prices will be you the consumer and the American economy.
Taking the full cost of wind and other renewables into account, the Heritage Foundation’s Center for Data Analysis has found that an RES would: 1) raise electricity prices by 36 percent for households and 60 percent for industry; 2) cut national income (GDP) by $5.2 trillion between 2012 and 2035; 3) cut national income by $2,400 per year for a family of four; 4) reduce employment by more than 1,000,000 jobs; and 5) add more than $10,000 to a family of four’s share of the national debt by 2035.
And that is just the “cap” half of President Obama’s Cap and Ban approach. The first Obama oil drilling ban already caused some oil rigs to leave U.S. waters entirely. The threat of a second moratorium effectively created a de facto oil drilling ban and, even if they lose in court, the Obama Interior Department can further the de facto moratorium “through tough new safety regulations and by extending the time it takes to review drilling applications.” Studies show that more than 200,000 jobs are tied to the offshore drilling industry and 35,000 workers are directly involved each day when the rigs are in use. The American Petroleum Institute forecasts that if the drilling ban continues, more than 120,000 jobs could be lost in the Gulf Coast and key resources abandoned or moved elsewhere.
Worse, CNN reports that shallow water drillers say the Obama administration has not issued any permits since April 20, effectively creating a stealth ban on all offshore drilling. Heritage analyst David Kreutzer has crunched the numbers and found that a full Obama administration ban on all offshore drilling would be absolutely devastating to the U.S. economy. Between now and 2035, an offshore drilling ban would: 1) reduce GDP by $5.5 trillion; 2) reduce job growth by more than 1 million jobs by 2015 and more than 1.5 million jobs by 2030; and 3) increase the total expenditures for imported oil by nearly $737 billion.
After listening to locals testify about the economic catastrophe President Obama’s energy policies are already creating in the Gulf, former Democratic Sen. Bob Graham said he was disturbed by a “disconnect between Washington and the Gulf region about the sense of urgency needed.” There certainly is a disconnect between Washington and the rest of America. At a time of 9.5% unemployment, now is not the time to be inflicting costly Cap and Ban energy policies on the U.S. economy.

While I tend to think that Obama was born in the U.S. or is considered a U.S. citizen I do believe it is proper for him to follow the chain of Presidents in releasing his birth certificate and other documents.

The Truth About the Health Care Bills - Michael Connelly, Ret. Constitutional Attorney
Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system.
All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals.
Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated.
If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.
The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access, by the appointees of the Obama administration, of all of your personal healthcare in direct violation of the specific provisions of the 4th Amendment to the Constitution information, your personal financial information, and the information of your employer, physician, and hospital.
All of this is protecting against unreasonable searches and seizures.. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you.
It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment.
However, that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.
So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law It doesn't stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;
The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights.
Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress, I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.
For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights.
Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress, I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.
For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

Grayson, Progressives & Obama Will Use "Trick" to Pass Health Care
"Here's the "trick" that Obama, Pelosi and Reid are planning to use to ram ObamaCare through: it's called "reconciliation". As the Wall Street Journal explains, "House Democrats would pass a series of 'fixes' to the Senate bill. The Senate would then pass the House reconciliation bill, sending amendments to President Obama to a bill that -- strictly speaking -- didn't exist, because it hadn't yet emerged from the House. The House would then retroactively pass the Senate bill as is."
The President's "bi-partisan" health care summit has never been about compromise. This is only being done to give that perception. The Democrats are still planning on ignoring the American peoples' wishes. The Democrats are still planning to shove this bill down our throat using any means possible. So, now, Obama and the Democrats are going to use the dirty trick called reconciliation when this procedure is not meant to be used for new programs, but in fact used to make changes to existing programs. If they wanted to extend medicare/medicaid benefits to the 15% of citizens who are unhappy about their health care accessibility than that would be okay. But, they are using dirty, rotten alinsky tactics to sneak this bill through so that that can have both power and control over an additional 1/6th of the economy and our lives. These liberals are the most intrusive people and are intent on taking away our freedom and liberty via the health care bill. This is corruption of the worst kind. These dirty, rotten scoundrels must be stopped!! These politicians who want to shred our constitution and "remake" our country into some type of commie land must be stopped!! We must stop the progressives and save our country from tyranny. As you will see in this video, Alan Grayson and progressives are pushing for both the public option and to push the bill through by way of reconciliation.
